01 Introduction and Acceptance
These Terms and Conditions govern the use of the PARTS mobile app, developed and distributed by Parts S.r.l. Società Benefit (VAT no. 10996271218), available free of charge on the App Store (iOS) and Google Play (Android).
Installing and/or using the app constitutes full acceptance of these Terms. In case of disagreement, even partial, the user is invited not to use the app and to uninstall it.
02 Service Description
PARTS is a digital platform for accessing museum content. The app allows visitors to:
- Activate access to partner museum content via code, QR code, NFC or — for some museums — in free access mode.
- Explore artworks through structured interactive modes (audio, text, thematic modes designed for different visitor profiles: standard, child, expert, blind/visually impaired, and others).
- Listen to audio content in multiple languages.
The app is intended exclusively for personal and non-commercial use.
03 Usage Requirements
- Users must be at least 14 years old. Minors under 14 may use the app exclusively under the supervision of a parent or guardian.
- An iOS or Android device compatible with the minimum requirements indicated on the official stores is required.
- An active internet connection is required for the first download of content. Some content may remain available offline after the first download.
- Users are responsible for their own data connection and for any costs charged by their telecom operator.
04 Access Modes
The PARTS app can be publicly downloaded and used by anyone meeting the requirements of Section 3. In the current version, user account creation is not foreseen: the app works anonymously and does not require entering identifying personal data.
Access to a specific museum's content requires activation via:
- QR code or NFC available at the museum;
- Unlock code provided by the museum or through official channels;
- Free access, for museums that allow it.
Future versions of the app may introduce optional features subject to account registration (e.g. personal notes, favorites, visit history). In that case, these Terms will be updated and users will receive adequate information.
For data processing details, please refer to the Privacy Notice.
05 Proper Use of the App
Users agree to:
- Use the app exclusively for lawful and personal purposes.
- Not attempt to access a museum's content without having properly unlocked it through one of the methods provided.
- Not share, distribute or publish unlock codes reserved for paying visitors of a specific museum.
- Not engage in reverse engineering, decompilation, disassembly or any activity aimed at extracting the source code of the app or protected content.
- Not use bots, scrapers or automated systems to interact with the app or PARTS servers.
- Not attempt to compromise the security of the app, the backend infrastructure or other users' data.
- Not use the app for illegal, fraudulent activities, harmful to others' rights, or contrary to applicable law.
Violation of these rules may result in suspension or termination of access under Section 10.
06 Intellectual Property of Content
All content delivered through the app is protected by intellectual property rights.
6.1 Content owned by Parts S.r.l.
The textual descriptions and audio content of artworks, generated and produced by Parts S.r.l. through its own editorial and technological processes (including the internal artificial intelligence pipeline), are the exclusive property of Parts S.r.l. Società Benefit, unless otherwise agreed with partner museums.
Also property of Parts S.r.l. are:
- The app software and backend infrastructure
- The user interface, design, trademarks, logos
- Exploration modes, thematic paths and editorial structure
- Any original element generated by the PARTS team
6.2 Museum and rights holder content
The artworks represented (artwork images, photographic reproductions) remain the property of the respective partner museums or authors and rights holders, and are used in the app based on specific agreements between Parts S.r.l. and individual museums.
6.3 License to the user
The user is granted a personal, non-exclusive, non-transferable, free and revocable license, limited to enjoying content within the app itself.
It is expressly prohibited to:
- Record, reproduce, download outside the mechanisms provided by the app, redistribute or publish audio or textual content on other channels (web, social networks, podcasts, etc.).
- Use the content for commercial, public educational, exhibition or any other non-strictly-personal purposes.
- Create derivative works based on the app's content.
- Remove or alter trademarks, logos, copyright notices or any indication of authorship.
- Attempt to extract audio or text files through analysis, traffic interception or reverse engineering techniques.
Any use not expressly authorized by these Terms is prohibited and constitutes a violation of the intellectual property rights of Parts S.r.l. and/or third party owners.
07 Service Availability
Parts S.r.l. commits to ensuring maximum service continuity but provides no guarantee of uninterrupted availability. The app may be temporarily unavailable due to scheduled or extraordinary maintenance, technical updates, force majeure or events not attributable to the Controller, network unavailability, third-party cloud infrastructure or service issues.
Some features require an active internet connection. The experience within museums may be affected by the quality of the connection available on site; for this reason, the app is designed to allow, where possible, offline enjoyment of previously downloaded content.
08 App Updates
Parts S.r.l. may release app updates to introduce new features, fix bugs, improve security or comply with regulatory obligations. Some updates may be necessary for the app to function properly; users are invited to install them promptly. Failure to install critical updates may result in limitation of some features.
09 Limitation of Liability
Within the limits allowed by law, Parts S.r.l. is not responsible for:
- Damages arising from app malfunctions not attributable to its own gross negligence or willful misconduct.
- Inaccuracies, omissions or late updates in historical-artistic content, when derived from information provided or validated by partner museums.
- Service interruptions due to external causes (network providers, third-party cloud infrastructure, app stores).
- Malfunctions of the user's device or incompatibilities not known at the time of app publication.
- Loss of local data resulting from app uninstallation or device reset by the user.
These limitations do not apply where they cannot be excluded by law (e.g. liability for willful misconduct or gross negligence, personal injury, inderogable consumer rights).
10 Suspension and Termination
10.1 By the user
Users may terminate use of the app at any time by uninstalling it from their device. They may also request deletion of usage data associated with their technical identifier by writing to info@partshub.it (see Privacy Notice, Section 7).
10.2 By Parts S.r.l.
Parts S.r.l. reserves the right to suspend or limit access to the app, including by blocking the technical identifier, in case of:
- Violation of these Terms.
- Fraudulent, illegal or abusive use of the app.
- Attempts to compromise the security of the infrastructure.
- Legal obligations or requests from competent authorities.
In case of serious violations, suspension may occur without notice.
11 Changes to the Terms
Parts S.r.l. may update these Terms to reflect service evolution, regulatory changes or technical needs. Substantial changes will be communicated through in-app notification and published on this page with the date of the last update indicated. Continued use of the app after the update constitutes acceptance of the new conditions.
12 Applicable Law and Jurisdiction
These Terms are governed by Italian law.
For any dispute arising from the use of the app, the Court of the consumer's place of residence or domicile shall have exclusive jurisdiction, where applicable, subject to mandatory consumer protection rules (Italian Legislative Decree 206/2005 — Consumer Code).
For users residing outside Italy, the jurisdiction of the courts of their country of habitual residence is also reserved, where mandatory under EU law.
